Notice

1. Title

This is the Regulatory Standards (Excluded Legislation) Notice 2026.

2. Commencement

This notice comes into force on the later of 1 July 2026 or the day after it is published.

3. Interpretation
In this notice, unless the context otherwise requires:
the Act means the Regulatory Standards Act 2025
Act includes parts of Acts
Bill includes parts of Bills
Secondary legislation includes parts of secondary legislation.

4. Exclusions from the Act

Bills

(1) The Act does not apply to the following general classes of Bill as specified for the purposes of item 9 of Part 1 of Schedule 2 of the Act:

(a) Bills that amend Acts of a kind referred to in clause 4(3) of this notice:

(b) Bills that amend secondary legislation of a kind referred to in clauses 4(2) or 4(3) of this notice:

(c) Bills that amend secondary legislation of a kind referred to in Part 3 of Schedule 2 of the Act.

Secondary legislation

(2) The Act does not apply to the following general classes of secondary legislation or proposed secondary legislation as specified for the purposes of item 7 of Part 3 of Schedule 2 of the Act:

(a) Secondary legislation made under an Act of a kind referred to in Part 2 of Schedule 2 of the Act (including those classes in the Schedules of this notice): Secondary legislation that amends secondary legislation of a kind referred to in clause 4(3) of this notice:

(b) Secondary legislation that prescribes forms, or the content of forms:

(c) Secondary legislation that primarily relates to the revocation of secondary legislation identified as redundant, spent, ceased to have effect or no longer required:

(d) Secondary legislation made under the Royal prerogative:

(e) Secondary legislation that implements the outcomes of trade-related negotiations or agreements with international counterparts, including market access requirements:

(f) Secondary legislation (the new legislation) if all of the following apply:

(i) the new legislation, with or without modification, replaces or corresponds to other secondary legislation that is revoked (the former legislation):

(ii) clause 15 of Schedule 1 of the Legislation Act 2019 (as inserted by section 58 of the Legislation Amendment Act 2026) (the new publication clause) applies to the former legislation:

(iii) the new legislation is made, and the former legislation is revoked, before the publication deadline that applies to the former legislation under the new publication clause:

(iv) the explanatory note for the new legislation contains a statement to the effect that the new legislation replaces, or corresponds to, the revoked legislation without substantially changing its legal effect.

Mixed classes

(3) The Act does not apply to the following specified classes of legislation or proposed legislation as specified for the purposes of item 9 of Part 1, item 9 of Part 2 or item 7 of Part 3 of Schedule 2 of the Act:

(a) Legislation that provides powers to respond to emergency situations, consisting of the legislation set out in Schedule 1:

(b) Legislation relating to the implementation of existing international trade agreements, consisting of the legislation set out in Schedule 2:

(c) Legislation giving effect to specific types of bi or multilateral agreement (namely, mutual assistance in criminal matters, reciprocal social security, child support, extradition treaties, and double tax agreements), consisting of the legislation set out in Schedule 3:

(d) Legislation updating text of an international agreement in legislation once New Zealand has accepted the changes, consisting of the legislation set out in Schedule 4:

(e) Legislation concerning constitutional matters or that requires consultation with the judiciary, consisting of the legislation set out in Schedule 5:

(f) Legislation implementing agreements between the Crown and iwi and hapū, consisting of the legislation set out in Schedule 6:

(g) Legislation made by independent Crown entities or the Reserve Bank of New Zealand providing exemptions, consisting of the legislation set out in Schedule 7:

(h) Legislation that is administrative with negligible or no ongoing public impact (meaning interactions between public sector and/or state sector agencies, providing for how public sector agencies govern themselves, or otherwise administrative), consisting of the legislation set out in Schedule 8.

This notice excludes classes of legislation from the requirements set out in the Regulatory Standards Act 2025 (the Act) and is made under section 7 of that Act. This notice may be made after it is approved by a resolution of the House of Representatives.

Classes of legislation are excluded for reasons such as (but not limited to) practicality or appropriateness. For example, routine legislation which solely prescribes forms or an Order in Council to commence parts of an Act would be impractical to apply the requirements of the Act to.

Where relevant, classes of legislation are organised by administering agency of the primary Act (as identified at the time of drafting). Headings are for administering agency ease of use, and any changes in responsibility do not affect the exclusion of classes.
