Overview
As the government’s lead regulatory advisor, the Ministry for Regulation (the Ministry) provides second opinion advice on regulatory initiatives.
Agencies must engage with the Ministry on regulatory proposals
- at the early stages of policy development
- through agency consultation on draft Cabinet papers.
We review information about:
- the problem or issue being addressed
- the rationale for government intervention
- the proposed policy objectives
- consultation plans.
How the Ministry prioritises engagement
The Ministry prioritises engagement on regulatory proposals that:
- have the potential for significant impacts or risks, or
- affect the use, exchange, or protection of property rights.
In addition to early engagement agencies must complete regulatory impact analysis.

What do agencies need to do?
Agencies should contact us as soon as possible after developing their first briefing to a Minister regarding a regulatory initiative using the early engagement form.
